Terms of Service
Effective date: [to be set on publication] · Last updated: October 27, 2026
These Terms govern your use of Acidni Voice (the "Service"), an AI phone and text receptionist provided by Acidni LLC ("Acidni," "we," "us"). By creating an account you agree to these Terms on behalf of yourself and the business you represent ("Customer," "you").
1. The Service
The Service answers phone calls and text messages on numbers you designate, using automated artificial-intelligence ("AI") speech and language models, and may take messages, answer questions from information you provide, book appointments, transfer calls, send notifications and follow-up texts, and integrate with third-party systems you connect.
2. AI disclosure
The Service identifies itself to callers and texters as an AI assistant at the start of each conversation. You may not disable, obscure or contradict this disclosure, or instruct the Service to claim to be a human.
3. Call recording and transcription
Conversations are transcribed, and may be recorded, to provide the Service. The Service tells callers that the call may be recorded. You are responsible for complying with all recording and wiretap laws that apply to your calls, including all-party-consent states (for example California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington), and for any additional notices your industry requires.
4. Telephone Consumer Protection Act (TCPA), texting and consent
- You will use the Service to send text messages or place calls only to people who contacted you first or who gave the prior express consent required by law (prior express written consent for marketing calls or texts using automated technology or artificial or prerecorded voice).
- You will not use the Service for unsolicited marketing, robocalls, or to contact numbers on the National Do Not Call Registry or your internal do-not-call list without a valid exemption.
- The Service honors STOP, UNSUBSCRIBE, CANCEL, END and QUIT for texts, and opt-out requests on calls, and keeps an internal do-not-contact list. You will not override opt-outs.
- You will respect calling-time restrictions (generally 8 a.m. to 9 p.m. in the recipient's local time) and any state "mini-TCPA" laws.
- You will complete any carrier registration (for example A2P 10DLC brand and campaign registration) that we ask you to support.
5. Your content and instructions
You are responsible for the accuracy of the information, FAQs, documents, greetings and instructions you provide, and for decisions you make based on the Service's output. The Service may make mistakes. It is not a substitute for professional, medical, legal, financial or emergency services, and it must not be used for clinical decision-making or emergency response.
6. Acceptable use
You will not use the Service for unlawful, deceptive, harassing or discriminatory purposes, to collect payment card numbers by voice, to impersonate others, or in violation of carrier or Twilio messaging policies.
7. Phone numbers
Numbers we provision remain subject to carrier and provider rules. On cancellation we may release provisioned numbers after a grace period unless you request a port-out beforehand.
8. Fees, usage and billing
Plans are billed monthly in advance through Stripe. Minutes beyond your plan's included minutes are billed in arrears at your plan's per-minute overage rate. Fees are non-refundable except where required by law. You can cancel anytime, effective at the end of the current billing period. We may change prices with 30 days' notice.
9. Regulated data
Do not use the Service to process protected health information (PHI) unless you are on the Enterprise Compliance plan and have signed our Business Associate Agreement. Do not send payment card data, Social Security numbers or similar sensitive data through the Service except as expressly supported.
10. Privacy
Our Privacy Policy describes how we handle personal information. As between the parties, you control caller data processed for you, and we process it on your behalf.
11. Third-party services
The Service relies on providers including Twilio (telephony), Microsoft Azure (hosting, storage, AI and email), Anthropic (AI models, via Microsoft Foundry), and Stripe (payments). Integrations you connect (CRMs, calendars, helpdesks) are governed by their own terms.
12. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACIDNI DISCLAIMS ALL IMPLIED WARRANTIES, AND ACIDNI'S TOTAL LIABILITY IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM. ACIDNI IS NOT LIABLE FOR MISSED CALLS, LOST PROFITS OR INDIRECT DAMAGES.
13. Indemnity
You will defend and indemnify Acidni against claims arising from your content, your instructions to the Service, or your violation of these Terms or of telemarketing, privacy or recording laws.
14. Termination
We may suspend the Service for non-payment, suspected abuse, or legal or carrier requirements. You may export your data before cancellation.
15. Governing law
[State], without regard to conflict-of-laws rules. [Venue / arbitration clause to be determined by counsel.]
